A new class-action lawsuit alleges that Nintendo of America has unjustly profited by failing to pass on tariff refunds to its customers. The legal action, filed in a Seattle federal court, centers on the 25% tariff levied on many Chinese-made electronics during the previous U.S. administration.
The plaintiffs argue that when Nintendo subsequently raised the U.S. price of its popular Switch gaming console and related accessories, it explicitly cited these government-imposed tariffs as the cause. However, the lawsuit claims that after many of these tariffs were later suspended or refunded by U.S. authorities, Nintendo did not lower prices or reimburse consumers for the now-invalidated cost increase.
The core allegation is one of unjust enrichment. Customers contend they paid an inflated price based on a specific cost burden that was later eliminated for Nintendo, and the company has a duty to return those excess funds. The suit seeks compensation for all U.S. consumers who purchased affected Switch hardware during the relevant period.
Nintendo has not issued a public statement regarding the litigation. The case highlights ongoing legal questions about corporate responsibility when temporary regulatory costs are reversed after being factored into consumer pricing.
